How to do it

                                                      MARRIAGE LICENSE PROCEDURE AND INFORMATION -- for ALL OHIO Counties

Courthouses are NOW OPEN.  You have 60 days to get your license prior to your ceremony.  

Congratulations your upcoming nuptials, I know you are excited and I want your premarital journey to be smooth so I’ve listed the surrounding court houses where you may be obtaining your license. I can marry anyone from Ohio in Ohio no matter what county. Each county fee is different, locations and hours of operation are different, so make sure you do research on the where and when. Here are some generalized facts about obtaining your MARRIAGE LICENSE for OHIO:

You go to the COURTHOUSE in the COUNTY WHERE YOU HAVE RESIDENCE. 

You BOTH must go to the courthouse, there the magistrate will give you your Legal Marriage License. 

You call me and schedule a date and time.  I will call you a few days before to confirm and again on your wedding day.

Bring that license to your ceremony and I will sign and mail it.

If you should forget your license, I will still perform a ceremony, but later or the next day you MUST bring me that license so I can legally process it. 

For All Courthouses: 

You must be 18 years of age or obtain the consent of your parents, meaning they need to go with you to the court house.

BOTH partners must be present in person when you apply. If either or both parties are physically incapacitated, their physician must complete an affidavit stating the physical disability, and this affidavit shall be filed with the application for the marriage license.

 

Each party must bring a valid picture I.D. Any of the following are acceptable means of a picture I.D., a valid driver's license, a state ID., Immigration and Naturalization Service (I.N.S.) Visa. All social security numbers are for identification purposes only and are held in confidence.

 

At least one party member must be a resident of that County in which you are applying.

If the applicant's address on the I.D. does not reflect that they live in that County, they need to bring proof that they actually do reside in the county.  Acceptable forms of proof are a utility bill, lease, pay stub, auto registration, etc. In either circumstance, your license will be valid statewide. . If neither partner are residents you must apply for your license in the county where the marriage will take place. I am in Montgomery County so you would need to apply there.

 

Information Needed to Complete an Application

  • Full name (first, middle, last) of both applicants                                                     

  • Social Security number of both applicants

  • Current address of both applicants

  • Birth City & State of both applicants

  • Birth Date of both applicants

  • Name of biological/adoptive parents of both applicants

    • Mothers’ maiden names are required

  • Occupation of both applicants

  • Divorce Information of ALL prior divorces/dissolutions

  • Name & Date of Death of deceased spouses

  • First names of children who were minors at time of divorce/dissolution or death of spouse

  • Name of party to perform marriage (if known)

  • Place of marriage (if known)

 

If you were previously married, the date of your divorce or the date of your spouse's death must be provided. Bring a certified copy of the divorce decree or death certificate. If necessary, a copy of your divorce records or spouse's death certificate can be ordered from your local vital records office and mailed to you.    Your license will expire 60 days from the date it is issued. Once it expires, it can no longer be used to get married and you will need to purchase a new one.

Second floor of the Montgomery County Courts Building, 41 N. Perry St., Dayton, OH 45402.  Hours are 8:30 a.m. to 4:15 p.m. on Monday thru Friday.  Plan to arrive by 4 p.m. as the marriage license application process takes time.     937-225-4656

-Bring $75.00; COURT ACCEPTS: Cash, Money Order, Cashier's Check, American Express, Discover, Mastercard credit and Debit cards, plus a convenience fee of $1.80.   You may make arrangements on line to have your license mailed for $4.00, but arrange for it, otherwise you pickup in person.

Greene County Probate Court, 45 North Detroit Street, Courthouse, Xenia, Ohio, between the hours of 8:00 A.M. to 3:30 P.M., Monday through Friday. 937-376-5280 The cost of the license is presently $65.00 cash only (no checks, credit or debit cards), and must be paid upon completion of the application.

Court Hours: Monday - Thursday 8:00 a.m. - 4:00 p.m.
Friday 8:30 a.m. - 4:00 p.m. License Please allow one (1) hour to complete the application process.
